Terms of Service

1. Definitions

• “Service”: the Post On Go web platform and related features.
• “User”: any person or entity accessing the Service.
• “Content”: materials you upload, create, schedule, or manage through the Service.
• “Third-Party Data”: information obtained from social platforms via OAuth.
• Operator: Nefrox Consulting, LLC, 2600 Lake Ridge Rd, The Colony, Texas, United States.

2. Eligibility

You must be at least 18 years old, legally able to enter contracts, and provide accurate registration information. If you use the Service on behalf of an organization, you represent that you have authority to bind it.

3. Accounts & security

• You are responsible for protecting your credentials and for activity under your account.
• Notify us promptly of unauthorized access.
• We recommend enabling two-factor authentication (2FA).

4. The Service

Depending on your plan, Post On Go may provide scheduling and publishing to connected social networks, analytics, multi-client profiles, team roles, client approval portals, AI-assisted drafting, asset libraries, and notifications. Features may change with reasonable notice.

5. Plans & billing

• Free and paid plans are offered; pricing is shown on the pricing page and may change with 30 days’ notice.
• Paid plans are billed in advance via Stripe in USD unless stated otherwise.
• Except for serious Service failures attributable to us, started billing periods are generally non-refundable. Refund requests within the first 7 days of a new paid subscription may be reviewed case by case if premium features were not used.
• Failed payments may trigger a 7-day grace period before access is limited.

6. Cancellation

You may cancel anytime from account settings. Paid access continues through the end of the paid period. After cancellation you generally have 90 days to export data before deletion. We may suspend or terminate accounts that violate these Terms.

7. Acceptable use

You must not use the Service to publish illegal or harmful content; spam or phishing; unauthorized automation that violates third-party terms; infringement of IP rights; account sharing beyond your plan; or attacks on our infrastructure. Violations may result in immediate suspension without refund.

8. Intellectual property

Post On Go software, branding, and design remain our property. You retain ownership of your Content and grant us a limited license to host and process it solely to provide the Service. You are responsible for licenses needed for third-party materials you publish.

9. Third-party platforms

Connecting social platforms means you also accept those platforms’ terms. Post On Go acts as a technical intermediary and does not control third-party API availability, policy changes, or enforcement against your social accounts. We only use official APIs and do not use unauthorized bots or scraping.

10. Availability

We aim for high availability excluding planned maintenance, but do not guarantee uninterrupted service. Temporary outages do not automatically entitle refunds except as agreed for Enterprise plans.

11. Limitation of liability

To the fullest extent permitted by law, the Service is provided “as is.” Our total liability for claims relating to the Service is limited to the amounts you paid us in the three months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or for content you publish.

12. Indemnity

You agree to indemnify Nefrox Consulting, LLC / Nefrox SPA against claims arising from your misuse of the Service, your Content, or your violation of law or these Terms.

13. Privacy

Personal data is handled under our Privacy Policy, which forms part of these Terms.

14. Changes

We may update these Terms with at least 30 days’ notice for material changes. Continued use after the effective date means acceptance. If you disagree, cancel before the changes take effect.

15. Governing law

These Terms are governed by the laws of the Republic of Costa Rica. Disputes should first be addressed in good faith; otherwise the parties submit to the jurisdiction associated with 2600 Lake Ridge Rd, The Colony, Texas, United States. EU users may also use the European Commission ODR platform.

16. General

These Terms and the Privacy Policy are the entire agreement. If a provision is invalid, the rest remains in force. Failure to enforce a right is not a waiver. You may not assign rights without our written consent; we may assign in a merger or acquisition.
